Welcome to the Cen-Tex Smokers LLC website (the “Site”). By accessing or using our Site, you agree to comply with and be bound by these Terms and Conditions (“Terms”). Please read these Terms carefully. If you do not agree with these Terms, please discontinue use of the Site.

1. Acceptance of Terms

  • By accessing and using our Site, you acknowledge that you have read, understood, and agree to these Terms in full. If you do not agree, please do not use the Site.

2. Changes to Terms

  • Cen-Tex Smokers LLC reserves the right to update or modify these Terms at any time. Any changes will be effective immediately upon posting to the Site. Continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.

3. Use of the Site

  • Eligibility: This Site is intended for individuals 18 years or older. By using the Site, you confirm that you are of legal age to form a binding contract with Cen-Tex Smokers LLC.
  • Permitted Use: You agree to use the Site only for lawful purposes and in accordance with these Terms. Unauthorized use of the Site, including but not limited to hacking, fraudulent activities, and transmitting viruses or other harmful material, may result in legal action.

4. Product Information and Availability

  • Accuracy: We make every effort to ensure that product descriptions, pricing, and availability are accurate on the Site. However, we do not guarantee that information is complete, current, or error-free.
  • Product Availability: Cen-Tex Smokers LLC reserves the right to modify or discontinue products at any time without prior notice. Pricing, availability, and descriptions are subject to change.

5. Purchases and Payment Terms

  • Payment Requirements: Full payment is required at the time of order for all Low Country Cookers, Live Fire Cookers, and Live Fire Tools. For Offset Smokers and Custom Trailers, a 50% non-refundable deposit is required to secure your build in our fabrication schedule, with the remaining balance due 10 business days before completion.
  • Payment Methods: We accept major credit cards (subject to a 2.9% processing fee) and ACH payments. Your order will be processed only once full payment (or the required deposit for certain items) is received.

6. Order Changes, Cancellations, and Refunds

  • Order Finalization: Once an order is placed and payment is received, it is considered final. No changes, customizations, or cancellations are allowed.
  • No Refunds: Due to the custom nature of our products, all sales are final, and no refunds will be issued once an order is confirmed and paid.

7. Shipping Policy

  • Cooking Equipment: Cen-Tex Smokers LLC does not coordinate or facilitate shipping for Offset Smokers, Low Country Cookers, Live Fire Cookers, or Live Fire Tools. Customers are responsible for arranging their own shipping through a third-party logistics provider. We will ensure items are safely loaded and ready for transport.
  • Soft Goods: All soft goods orders placed Monday through Friday will ship out the following Tuesday. Cen-Tex Smokers LLC is not responsible for any delays caused by the shipping carrier once the package has left our facility.

8. Intellectual Property Rights

  • Content Ownership: All content on the Site, including text, images, graphics, logos, and product descriptions, is the property of Cen-Tex Smokers LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws.
  • Limited License: You are granted a limited, non-exclusive, non-transferable right to access and use the Site for personal, non-commercial purposes. Any other use, including copying, distribution, or modification of Site content, is strictly prohibited without prior written permission from Cen-Tex Smokers LLC.

9. Limitation of Liability

  • Cen-Tex Smokers LLC shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of, or inability to use, the Site, including but not limited to damages for loss of profits, data, or goodwill.
  • Our liability is limited to the fullest extent permitted by law, and we disclaim all warranties, express or implied, regarding the Site and our products.

  • The Site may contain links to external websites. Cen-Tex Smokers LLC does not control or endorse these third-party sites and is not responsible for their content, privacy practices, or any losses or damages incurred in connection with their use. Accessing third-party sites is at your own risk.
